Welcome to the Flydini Test Site. We hope that you enjoy browsing the Site, which is intended as a showcase to demonstrate the look and feel of the forthcoming Flydini search engine.
You are one of a privileged group, who have been invited to test the user experience of the new search engine for travel industry professionals, to be known as “Flydini.com”, and your preview is subject to you complying with the terms and conditions set out below (the “Terms and Conditions”). If you do not agree to be bound by the Terms and Conditions, then you will not be allowed to take part in the preview experience.
NB that the Flydini Test Site is not a live website and you will not be able to make any bookings through the Flydini Test Site. Your preview is just a chance for us to demonstrate to certain members of the travel industry what our search engine can do. When the Flydini site goes live, it is intended that travel agents will be able to book flights using the Flydini service.
Confidentiality
You acknowledge that the existence of the Flydini service and the set up, user interface, and look and feel of the website, all comprise sensitive business confidential information (“Confidential Information”), which could cause harm to Flydini.com and its investors, if such Confidential Information was disclosed other than in accordance with Flydini’s marketing strategy. You must not disclose any Confidential Information to any persons, save to the limited extent required to recommend the forthcoming Flydini service within your respective organisations. Without prejudice to the generality of the foregoing, you agree not to disclose any information, which might allow a third party to try and replicate any part of the Confidential Information in a way which would or might damage the business or marketing plans of Flydini.com. You further agree not to attempt yourself to use the Confidential Information to create or support a competitive service to the forthcoming Flydini.com service.
Intellectual Property
- Any materials on the Flydini Test Site, including without limitation any documentation, content, text, data, graphics, images, interfaces or other materials or works of authorship, (the "Materials") are copyrighted materials owned by or licensed to Flydini.com. All rights are reserved. The Materials contain trademarks, service marks and trade names which are owned by Flydini.com and its affiliates, and may also contain brand and product names which are trademarks, service marks or trade names of third parties which are owned by their respective owners. You are hereby authorized to view, but not to download, cache, copy, and/or print the whole or any part of the Materials.
- You agree not to copy, reverse engineer, or attempt to discover any source code, distribute or create derivative works based on the code underlying the Flydini Test Site, either in whole or in part. You agree not to access the Flydini Test Site by any means other than through the interface that is provided by Flydini.com for use in accessing the Flydini Test Site. In addition, any software that is made available from this Flydini Test Site, including, without limitation, all HTML code and web controls, are owned by or licensed to Flydini.com. Any reproduction or redistribution of this software is expressly prohibited.
Privacy
As consideration for obtaining a preview of the Flydini.com search engine capabilities, you agree that we may retain your contact details for marketing purposes and to contact you about the Flydini.com service.
Applicable Law
These Terms and Conditions as well as any disputes that may arise pursuant to these Terms and Conditions or your use of the Flydini Test Site are subject to the laws of England and Wales, without reference to its conflict of law principles. Any legal actions that may arise will be filed in the courts of England and Wales, and the parties hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms and Conditions.
